New York, NY, United States (AHN) -- A New York City police officer accused of sodomizing a man with his baton while arresting him swore his innocence Thursday in court, according to reports.
Officer Richard Kern reportedly told the judge that 25-year-old Michael Mineo's accusation of him using his baton to sexually violate him in October of 2008 is absolutely false.
Mineo claims that as Kern and two others arrested him, Kern used his police baton to sodomize him as he lay face down on the ground of the subway station at Prospect Park, according to police reports.
Kern stated in court that he put his baton away before handcuffing Mineo during the arrest. However, Kern told the court that before getting out the handcuffs that he had used the baton to prevent Mineo from using his legs by holding them down with it, according to reports.
Kern testified he did not stick the baton in Mineo's anal cavity as Mineo claimed he did.
According to Mineo's statement, he ran from police because he was smoking marijuana and did not want to be caught because he claimed he did not have identification on his person, reports stated.
But Kern stated Mineo did have identification on him at the time of his arrest.
Kern pleaded not guilty to the charges of aggravated sexual abuse and assault, while officers Andrew Morales and Alex Cruz pleaded guilty to hindering prosecution and official misconduct.
Officials did not state the punishment if the three officers were to be found guilty.
