I couldn't find exactly who or what would do the fining. Since the MPAA is a group put together by the seven largest studios (Disney, Sony, Paramount, Universal., Warner Bros., 20th Century Fox and until recently, MGM), there may be some kind of agreement between the distributors, studios and the MPAA where they have to adhere to certain standards or be fined.
